Burg Simpson Leading National Hip Implant Litigation

Burg Simpson shareholder, Seth. A. Katz, has been appointed by the Hon. David A. Katz to serve as a member of the Plaintiffs’ Steering Committee in the multidistrict litigation against DePuy Orthopaedics, Inc. over the alleged failure of its ASR XL Acetabular Hip System.

Speaking of his appointment Mr. Katz said, “I am extremely honored to have been appointed to assume a leadership position in what may become one of the most high-profile litigations in recent years.” Mr. Katz continued, “The evidence certainly suggests that thousands of individuals from across the country have had their health compromised due to DePuy’s disregard for patient safety. Despite being aware of the problems and risks that the design of metal-on-metal joints carry and the mounting clinical evidence pointing to this problem, DePuy failed to provide adequate warnings of the health risks associated with their device to the public and the medical community. Our clients deserve justice and fair compensation for the pain, suffering and life-altering experience they must now live through.”

FDA Panel Votes To Keep Avandia On Sale

Avandia is to remain on the market after a Food and Drug Administration (FDA) advisory panel majority 'approved' the drug's safety. A 33-person panel was split 21-12 in its decision as to whether or not the drug should be removed from sale, despite concerns regarding Avandia's links to heart attacks and strokes. The FDA is now likely to accept the panel’s recommendation and permit the drug to remain on the market. A decision is expected shortly. Concerns regarding Avandia first came to light in 2007. Since that time GlaxoSmithKline has continually denied that its product is unsafe. However, the company has recently come under intense criticism after serious flaws were exposed in its clinical safety trials.

Merck Must Pay $8 Million To Fosamax Patient

A jury in New York has ordered Merck & Co. to pay $8 million in damages to a Florida women, after she successfully claimed that Fosamax caused her to develop osteonecrosis of the jaw (ONJ). ONJ is a condition that causes jawbone tissue death. Fosamax. This is the second case involving Fosamax to go to trial this year. In May, a jury ruled in favor of Merck but a third trial is scheduled for November 2010. The outcomes of these trials are expected to provide an indication of what may happen with hundreds of other pending lawsuits that allege that Merck knowingly marketed a potentially dangerous drug, and failed to warn patients of the potential risks involved in taking the medication.

Manufacturing problems lead to Tylenol recall

McNeil Consumer Healthcare has announced a voluntary recall of children’s liquid Tylenol®, Motrin®, Zyrtec®, and Benadryl®, following an investigation by the Food and Drug Administration (FDA). The FDA is advising parents and care givers to stop giving these drugs to children due to problems with the quality and purity of the medication produced at the company’s facility in Fort Washington, Pa. The advice comes after an investigation found that some of the raw materials used in the manufacture of these drugs might have become contaminated with infection-causing bacteria.
