Dangerous Children's Toys

The U.S. Consumer Product Safety Commission (CPSC) has opened a new office in Beijing in an attempt to improve safety standards and reduce the number of recalls manufactured by Chinese exporters. The office, the first of its kind to be opened overseas, will also help educate and enforce U.S. safety standards among Chinese manufacturers. According to the bbc , more than 50% of U.S. product recalls come from China.

Given that 90% toys sold in the U.S. are manufactured in China and Hong Kong, the decision to open a dedicated field office is certainly seen by many to be good news for American consumers. How effective the office will be, only time will tell. Each year literally thousands of children suffer serious personal injuries as a result of dangerous or defective toys, many are hospitalized and tragically, in some extreme cases, some children even die. If your child has been injured and you suspect that a poorly designed or manufactured product was to blame, Burg Simpson may be able to help you. Costco Colorado Stores in E-coli Scare

The Food and Drug Administration (FDA) has announced an immediate recall of Mauri Gorgonzola cheese sold in Costco stores in Colorado, after test revealed the presence of E.coli O157:H7 in unopened packets of the product. The cheese was distributed only to Costco stores in Colorado by DPI Specialty Foods Tualatin, OR, ITALY 34449, with a sell by date of 01/13/11 or 01/14/11.

To date, no illnesses have been associated with this recall, but the public is being warned to remain vigilant.
E.coli infections can be very serious if untreated. Common symptoms include, diarrhea and stomach pain. In extreme cases, E.coli infections can lead to kidney failure, with children and the elderly most at risk. News of this latest health scare comes only days after it emerged that officials in Colorado have been investigating a separate outbreak of E. coli infections among people who sampled or purchased cheeses that were part of a "Cheese Road Show" at Costco stores between October 14 and 17, 2010.

Popular Pain Medicine Linked to Heart Problems

The Food and Drug Administration (FDA) has issued a safety alert and advised patients prescribed propoxyphene to stop taking the drug, after studies revealed that the medication could lead to serious heart conditions. The FDA has warned doctors to stop prescribing the mediation and also requested the manufacturers recall their product.

Propoxyphene is an opioid pain reliever and is sold as a single product under the brand name Darvon. Propoxyphene is also sold as a combination product, mixed with acetaminophen and marketed under the brand name Darvocet. According to Dr. John Jenkins, director of the Office of New Drugs at the FDA's Center for Drug Evaluation and Research (CDER), “The drug's effectiveness in reducing pain is no longer enough to outweigh the drug's serious potential heart risks."

Specially, the study revealed that propoxyphene significantly altered the electrical activity of the heart and could increase the risk for serious abnormal heart rhythms, even if taken at the prescribed dosage.

Originally approved by the FDA in 1957, it is estimated that more than 10 million Americans took a prescription containing propoxyphene in 2009.

If you or a loved one has been injured as a result taking propoxyphene, then you may be entitled to money damages. Contact a Burg Simpson dangerous drug attorney today for a free consultation.

Apple Faces Class Action Lawsuit

A Judge in California has ruled that a lawsuit brought against Apple Inc. and AT&T can be given class action status. The class action will combine a number of individual lawsuits which allege that Apple’s exclusive agreement with AT&T forced consumers to commit themselves to a five-year service contract, rather than for the two-years they thought they were signing up for when they first bought their phones. Claims of anti competitive practice, first surfaced in 2007, given that iPhone users were forced to subscribe to AT&T’s network. This ruling will allow the named plaintiffs who represent the class of consumers to sue both Apple and AT&T for anti-trust law violations.

Dangerous Fuel Leak Prompts Lexus Recall

Toyota Motor Corp. has announced yet another recall, this time for its Lexus hybrid HS250h sedan. Recent crash tests conducted by the U.S. National Highway Traffic Safety Administration (NHTSA) uncovered a potentially dangerous defect. Specifically, investigators found that when 'rear-ended', the new model spilled too much fuel, posing a serious risk of fire. Toyota has suspended sales of the HS250h and intends to recall some 17,000 vehicles already sold to U.S. consumers. So far, there have been no reported injuries or deaths. This latest recall is yet another blow for the Japanese car maker. In April, Toyota announced a recall of the Lexus GS 460 SUV over stability concerns and the potential for the vehicle to rollover. Earlier in 2010, Toyota was forced to pay a $16 million dollar fine for failing to comply with government safety standards.

San Francisco Passes New Mobile Phone Law

San Francisco has become the first city in the nation to require all mobile phone retailers to display the amount of radiation emitted from their headsets. The new law, which was passed on Tuesday, June 16, has received a mixed reaction from consumer protection groups and the telecommunication industry. Many consumer groups have welcomed the introduction of the legislation, declaring it a major victory for cell phone shoppers. Some industry bodies have voiced concern that the move will damage commerce. Specifically the new law requires mobile phone retailers to list the specific absorption rate (SAR) of a device. Currently phones sold in the United States must not have a SAR rate greater than 1.6 watts per Kg. The scientific and medical community remains divided as to the potential dangers of radiation omitted from mobile

Jury Awards $300,000 Compensation in Yamaha Rhino Case

A Jury in Georgia has awarded more than $300,000 in damages to a man injured in a rollover accident involving a Yamaha Rhino utility-terrain vehicle (UTV). The verdict is believed to be the first successful personal injury lawsuit brought against Yamaha in connection with the Yamaha Rhino and its alleged safety problems. The verdict is certain to have implications for the hundreds of other pending lawsuits filed across the country. Litigation against Yamaha is centralized as part of a multidistrict litigation (MDL) in the U.S. District Court for the Western District of Kentucky. In a statement, Yamaha said it was “disappointed by the jury’s decision to find for the plaintiff in this case and will pursue all appropriate legal remedies, including possible appeal.”

General Motors Recalls 1.5 Million Vehicles Over Fire Risk

General Motors is recalling 1.5 million cars over fears that a heated washer system could potentially pose a fire risk. AT&T Class Action Settlement Excludes iPhone

AT&T will reverse its policy of "locking" its cell phones, after settling a class action lawsuit. Beginning July 2010, the telecom company will provide customers with an "unlock code", making it easier for customers to use their existing AT&T handsets on other compatible wireless networks. The overall aim is to make it easier for customers to switch carriers at the end of their contracts. There are some notable exemptions to this change, including Apple's iPhone. As part of the settlement, AT&T has admitted no previous wrong doing.
